The remote agile work of the “emergency” phase due to the covid is over since Thursday 1 September. Now we turn the page. What changes in practice? In recent days there was talk of a 100% extension of smart working for some categories of workers, then of any changes to the simplified communication mechanism, but after a summer of hypotheses, the publication of the simplification dl in the Official Journal – and the relative decree signed by the Minister of Labor Andrea Orlando – clarified things: after the Covid-19 emergency, agile work is fully operational, but not without some important news. The government’s goal is to de-bureaucratize the “new” way of working, to facilitate the process for companies.

The news on smart working from 1st September

The most significant changes concern communication by employers. In fact, from September the simplified communication – that is the possibility for employers to make agreements with employees without the obligation to ratify them in a formal way – has lapsed and we return to the individual agreement. However, this will take place in a simplified way compared to the period prior to the pandemic: employers, in fact, will not have to communicate employee membership per employee, but will have the possibility to communicate electronically to the ministry only the names of employees involved in the agile mode and the start and end date of remote work performance.

Workers who do not adhere to the agreement will therefore have to work in presence, including fragile workers or parents of children under 14, as there are currently no automatic mechanisms for any category of workers.

“The decree requires the employer to communicate electronically to the Ministry of Labor the names of the workers and the date of start and termination of the services in an agile way – explained the Minister of Labor Andrea Orlando -. This is a provision that makes the simplification of agile work is structural “. With these changes – explains the ministry – article 23 of the law of 22 May 2017 is reformulated, which provided for the obligation to communicate the individual agreement. “The need to simplify communication obligations arises from the need to make structural a procedure already widely tested in the emergency period – added the Minister of Labor -, with the aim of facilitating the process for employers without aggravating the ministerial offices for administrative obligations deemed unnecessary “.

Two months of smart working for public employees?

And there are news in sight for civil servants (even if at least for the moment this is a hypothesis). The Minister of the Ecological Transition Roberto Cingolani is expected to sign an energy saving plan in the next few days, articulated in different scenarios of severity. If Russia were to completely close the gas taps, urgent measures would be envisaged: a two-month smart working period could be triggered for all public employees in the event of a maximum emergency on the energy front, to reduce consumption.

It will then be the task of the new government to find a new form of stability in this area, making agile work for parents and the frail structurally. In this legislature, Parliament has not approved any smart working reform. We are stuck with the law of 2017, before the covid. Another era.
