Published the Ministerial Decree of 26 July 2022 “Approval of technical fire prevention standards for waste storage and treatment plants and plants”
What is it about?
The Ministry of the Interior published in the Official Gazette no.187 of 11 August 2022 the Ministerial Decree of 26 July 2022, the technical fire prevention standards for waste storage and treatment plants and plants.
The technical standards, established in Annex 1, apply to establishments and plants that carry out waste storage exclusively or at the service of waste treatment plants, excluding inert and radioactive waste, as well as to waste collection centers with a surface greater than 3,000 m². The technical standards referred to in Annex 1 apply to both new and existing plants at the date of entry into force of this one.
Paragraph 3 of article 3 contains indications for cases of modification and expansion of existing activities.
In article 4 the indications for the use of fire-fighting products, identification, qualification and acceptance of the manager, standards with which they must comply.
According to Article 5, the decree does not entail adjustments for activities which, on the date of entry into force:
- are in possession of qualifying documents also concerning the existence of the fire safety requirements, issued by the competent authorities, as required by art. 38, paragraph 1, of the decree-law of 21 June 2013, n. 69;
- are in compliance with the obligations provided for in articles 3, 4, 5 and 7 of the decree of the President of the Republic of 1 August 2011, n. 151.
The art. 5, relating to the transitional and final provisions, also specifies that, without prejudice to the obligations established by the current technical legislation on safety and fire prevention, the waste storage activities must comply with the provisions contained in the technical regulation referred to in annex 1 by 5 years from the date of entry into force of this decree..

The Ministerial Decree enters into force on November 9, 2022, 90 days after publication in the Official Journal.
Carry out the fire risk assessment according to the methodology reported in the technical rules, taking into account the general hazard characteristics of the stored waste as well as the disposal or recovery operations carried out.
Apply all the fire-fighting measures of the horizontal technical rule (RTO) by attributing the performance levels according to the criteria defined therein.
Apply the prescriptions regarding specific risk areas, and, where relevant, the prescriptions of the other vertical technical regulations.
