Yesterday in Sibari the very well attended municipal council convened in an “urgent” manner by the President Lino Notaristefano was held to discuss the question of the construction of a series of radiotelephony antennas.
The councilor for the environment and public works Leonardo Sposato opened the works. The rest is known history with the mayor Gianni Papasso who even went so far as to sign an order to suspend the works for health and, above all, public order issues. A strong act that I don’t think everyone would have done ”. At the beginning he said he was happy that last night’s city council had taken place in Sibari in the conference room, a sign of the attention of the administration for the entire municipal area and in the specific case of Sibari.
The report where the whole process was reconstructed and the question of the antennas was that of the mayor Gianni Papasso. The mayor recalled that the story began in September 2021 when, through the Calabria Suap portal, a request for an asynchronous services conference arrived, for the authorization to build an infrastructure serving the electronic communications networks of Cellnex property in via Plinio in the district of Sibari. “Right from the start – Papasso said firmly – the Municipality notified Cellnex of the notice of rejection which was then transformed at the beginning of 2022 into a final provision of denial of the construction of an infrastructure serving the electronic communications networks owned by Cellnex”. Then, in April, the Clients asked for the annulment of the refusal measure and then, the following month, Cellnex-Linkem-Fastweb appealed to the Calabria Regional Administrative Court. “A denial measure – insisted Mayor Papasso – to which my administration and the majority that compose it gave strength in the meeting of the City Council of 02/17/2022, with which “it was ordered that the Technical Office comply to the indications referred to in the Regulation of the Municipal Plan of Antennas (PCA), approved with Municipal Council Resolution n. 22 of 04/30/2015” (Antenna plan always wanted by my administration which in art. 10 prohibits the installation of antennas in the inhabited center and identifies sensitive sites, such as schools, churches and oratories and other highly urbanized centers and specific that Cassano is perhaps the only Calabrian municipality to have one)”. An act, however, which was not enough to convince the judges of the TAR who in May 2022 decreed the defeat of the municipality of Cassano by annulling the refusal provision and authorizing the company and the companies to build the antenna. “At that point, however – explained the mayor again – following a public meeting held on 12 January 2023, a situation of strong protest and social alarm emerged such as to give rise to fears that problems of public order could arise and I have decided to issue an order suspending any operation carried out on the construction site, with immediate effect, including all activities necessary for installing the antennas, doing everything in my possession. At the same time, the municipal offices and the mayor, realizing that, despite having issued such a strong act, this may not be enough because the national and regional institutions have decision-making power over the installation of antennas and, in the absence of a regional law in this sense that gives strength to them and to the Municipalities, they first sent a communication to the President of the Regional Council of Calabria, the Hon. the Filippo Mancuso, and for information to the President of the Regional Council, the Hon. Roberto Occhiuto, requesting a legislative intervention in this sense. To give more strength to these premises and, given that the continuation of this regulatory vacuum underlies a framework of socio-economic tension, since the infrastructure resulting from the social need for networks and connectivity is counterbalanced by the resistance and concern of the communities premises, which often leads to problems related to maintaining public order, the municipal council unanimously approved an agenda in which it requests the competent office to review its decisions, evaluating the adoption of any self-protection, revocation and suspension of the authorization to build the antenna and to invite the Regional Council to exercise its legislative power on the matter, dictating location criteria that minimize the risks to health and the environment deriving from exposure. In order to offer the Municipalities more tools for issuing strong provisions and/or determinations, suited to the protection of inhabited centers and sensitive points, with reference to the government of the territory as enshrined in the Constitution. Considering, above all, that the continuation of this regulatory vacuum underlies a framework of socio-economic tension, since the infrastructure resulting from the social need for networks and connectivity is counterbalanced by the resistance and concern of local communities, which often leads in issues related to the maintenance of public order.
