Accused of having violated the ban on approaching the former, a thirty-five year old from Frosinone was arrested by the carabinieri in Courmayeur (Aosta). The two share custody of the children.
The woman called 112 on Thursday evening after noticing him in a bar in the center of Courmayeur that she regularly frequents. The military arrested him because he violated the prohibition of approach (he was less than 100 meters).
This morning the prosecutor should have released him due to a lack of legislative updating which does not provide for the precautionary measure in cases of this type. Upon hearing the woman, however, the investigators framed last night’s behavior as the latest in a series: hence the hypothesis of the crime of stalking. Arriving from Frosinone in the Aosta Valley, the woman reported that having been flanked along the highway by her ex, driving a sports car, which she also saw under the hotel in Courmayeur where she is on vacation. So in the late morning the judgment was set for direct, with the man accused of violating the prohibition of approach and stalking. The man reported instead that he went to Courmayeur to spend a short vacation and that the presence of his ex did not affect the decision.
The file is entrusted to the prosecutor on duty, Giovanni Roteglia.
At the end of the hearing, the judge Maurizio D’Abrusco validated the arrest for violation of the prohibition of approaching but he considered that there were no conditions for stalking, which emerged only after the woman was heard by the investigators. By virtue of the alleged persecutory acts, the prosecutor Giovanni Roteglia had asked for the precautionary measure of house arrest in Frosinone, which however the judge could not grant in the presence of the sole violation of the prohibition of approach. The 35-year-old then returned to freedom, however subjected to the prohibition of approach ordered by the court of Frosinone. The judge returned the documents concerning the hypothesis of persecutory acts to the Aosta prosecutor’s office and the direct judgment for the violation of the approach ban was set for next 19 September. The man, driving a Ferrari, had come to Courmayeur with his new partner.
